Establishing a National Unity Government

Following the end of the Emergency period on 1 August or earlier, it is evident that the nation will continue to face a perilous and high risk situation because of the prolonged duration and unclear course of the pandemic as well as the deepening economic crisis.


In this situation, any decision to go ahead with political activities that are part of the conventional electoral process is fraught with unavoidable danger to the nation's socio-economic progress and security.
We can expect that millions of lives in the entire country will be exposed to an unpredictable and not easily contained pandemic in the electioneering.


There is no way any authority - medical or non-medical - can guarantee that the holding of a GE at the end of 2021 or even early 2022 can avoid a worst case health scenario which can bring the nation's economy and society to its knees.


At the same time we are cognisant of the need during this extraordinary period to ensure that the nation’s governance and political administration continues to function normally.


It is also important during this critical period that our political leadership enjoys the confidence and full support of Malaysians.


How to bring about a situation that can ensure a political leadership which has the clear support of the majority of our Parliamentarians without going through a potentially disastrous election is a challenge.


This challenge is more formidable as the present political dynamics has produced no strong evidence of a viable government with an undisputed majority. The same political stalemate may also come about with a new GE
Various approaches and strategies have been provided by some of the country's key stakeholders to resolve the political deadlock in the current emergency and pandemic.


Some of these proposals center around the formation of a national unity government that can be set up by an open and transparent democratice process when Parliament reconvenes.


It is timely for all stake players to put forward their views on the most practicable and least contentious method of arriving at such a national unity government and a political leadership that has the support of the clear majority of our Parliamentarians.


Proposal for Establishing a National Unity Government


A number of steps are involved in our proposal on how a national unity government can be established that is constitutionally defensible; transparent; and publicly trustworthy and acceptable.


1. Firstly the Yang DiPertuan Agong exercises the constitutional prerogative not to call for elections and instead proposes a procedure to instal a unity government under the leadership of a Prime Minister who has the undisputed support from a majority of the 222 parliamentarians.


2. All parliamentarians will write down his or her choice of Prime Minister. This will be done without the need for the proposer to reveal his identity and to avoid any repercussions arising from his choice.  The top 5 choices with the most nominations will be named without revealing the number. They will proceed to the next round of selection.


3. A similar process of anonymous selection will take place involving all parliamentarians choosing only one name from amongst the five. Should any one of the five receive an absolute majority of the votes, he or she will be deemed to be the Prime Minister


4. Should there be no absolute majority for any of the 5, the top two names with the highest votes will proceed to the final round of balloting


5. Following the identification of the top 2 picks, a last and final selection process will take place. This final selection  will be done openly so that all Parliamentarians can make known their preference as PM. This will also permit the PM to know where his support is coming from.


6. Upon his selection the selected Prime Minister will then be required to put together a unity government of his choice.  To ensure a national unity government he or she will be required to appoint at least one third of the Cabinet Ministers and Deputy Ministers from the members of the opposition. This will mean that the PMs own coalition will have two thirds of the Cabinet positions or even less should he be able to bring in members without any political affiliation who have strong records of integrity and merit.


7. Further to ensure regional balance and greater cohesion, 2 deputy prime ministers can be appointed.


8. This unity government can remain in place until GE 15 when the normal election system can come into play again


In summary this national unity government plan is proposed to ensure
i) the nation is not put at risk with an untimely election
ii) the nation’s prime minister and his cabinet ministers emerging from this process will have the mandate and legitimacy to govern until the next GE
iii) there will be a much more cohesive and effective government than what is current to run the country until the next due election.


We are hopeful that the process outlined can produce a unity government that is popularly acceptable, stable and effective during this extraordinary period of crisis.


We welcome feedback from other stake players on how to establish a national unity government that has the right qualities to take charge of our nation in its hour of need.

POLICE CARTEL AND POLICE INDEPENDENCE
We, civil society and political organizations, wish to highlight several critical issues related to the Royal Malaysian police, as follows:
1. We are horrified by Inspector General of Police (IGP) Tan Sri Abdul Hamid Bador’s claim, during an interview with Sinar Harian1 on 18 March 2021, that a cartel in cahoots with criminals is operating within the police force, and that the police force must be urgently cleansed from the influence of the cartel. This is the first time in modern history that the Chief Police Officer of our nation has openly made such a claim.
2. That claim was followed by another revelation by the IGP about the leakage of confidential information2 during Operation Pelican 3.0. The leakage resulted in failure of the police to apprehend the alleged head of the largest money laundering operation in Malaysia, Datuk Seri Nicky Liow. The IGP added that 34 persons are implicated, and that the majority are police officers, including senior police officers. This is a huge and significant number.
3. On 10 April 2021, the IGP3 publicly revealed that transfers of police officers ordered by him were suspended by the Home Minister, Datuk Seri Hamzah Zainudin. The IGP’s original order called for transfers, on 12 April 2021, of 71 senior police officers including state Chief Police Officers. The IGP said the Home Minister suspended the transfers while the IGP himself was on leave. The claims and revelations by the IGP clearly show that his orders were not followed. In other words, his orders were sabotaged, overturned, or compromised. The IGP said plainly that under the law, as Inspector General of Police, he is responsible for Command and Control of the Royal Malaysian Police (PDRM).
4. On 12 April, Home Minister Hamzah Zainudin denied4 that he had interfered in the transfers as Home Minister but added that suspension of the transfers was based on a majority voice of a meeting of the Police Commission (SPP), which he chairs. Hence, he did not deny his involvement in the suspension. Further, he indicated that the majority of the Police Commission do not support the transfers of senior police officers ordered by the IGP. Does this mean the IGP’s goal of cleansing PDRM before he retires cannot be acted upon? Does this mean the majority of the police officers whose transfers the IGP ordered have the backing of other parties such as members of the Police Commission?
5. On 15 April, the IGP claimed that the Department of Integrity and Standards (JIPS)5 is sheltering certain officers who are under investigation, while Datuk Ayob Khan, the Chief Police Officer of Johor, said he would not submit names of police officers to JIPS for investigation. When the Inspector General of Police and the Chief Police Officer of a state share mistrust of JIPS, it is clear that JIPS cannot effectively discharge its responsibilities. This is not only worrying. This is a clear, open declaration that JIPS is unable to function or is controlled by the cartel.
Based on the statements and claims, we can conclude the following:
i. Actions have been initiated to cause the Inspector General of Police to fail in discharging his duties, to such an extent that the IGP himself has had to announce that the police force must be cleansed from the activities of an internal cartel which is in cahoots with criminals.
ii. The Police Commission, chaired by the Home Minister, has interfered in the exercise by the Inspector General of Police of his powers and prerogatives to transfer officers.
iii. The Department of Integrity and Standards, JIPS, is unable to carry out its duties in a free, fair and effective manner.
Hamid Bador’s contract ends on 30 April 2021 (today). His contract was not renewed, despite his clear expression of desire to continue in office. He was appointed IGP as part of the government’s efforts to reform the police force and its administration. During his two years of service, the Independent Police Complaints and Misconduct Commission (IPCMC) was not established, However, his revelations about the operation of a cartel in the Royal Malaysian Police has shocked the public. Indeed, public opinion is that he has tried to take brave actions to cleanse PDRM.
Hence, we, the signatories of this memorandum, demand the following:
1. An Independent Police Complaints and Misconduct Commission (IPCMC), with the spirit and powers of the IPCMC proposed in 2005, must be established urgently and empowered. An IPCMC is the best medicine to address the problems of corruption, abuse of power and criminal practices in PDRM. An IPCMC will save PDRM. One of its fruits will be police personnel who will discharge their duties with sincerity and integrity. An IPCMC will restore public confidence in PDRM which is tainted with accusations of abuse of power, selective enforcement and now, of being controlled by a cartel.
2. The names of all persons who have been linked to the cartel must not be put forward as replacements for the IGP or for any positions in PDRM.
3. All persons who come forward to give information (whistle-blowers) about officers who engage in corrupt practices or criminal acts must be given shelter and protection because they are exposed to threats and actions by criminals, including those in uniform.
4. Will this IGP’s efforts to cleanse PDRM continue, now that his service is ended through non-renewal of his contract? Will his replacements continue the efforts he leaves unfinished? Or will we see the return and rise to high office of those whom this IGP has claimed are collaborators of criminals? If the eviction of the cartel from PDRM is not continued, we are deeply concerned that the decline of PDRM will remain unarrested, and reform efforts which have been initiated will be stalled.
5. A process to select the IGP and the Deputy IGP must be established. The process must be reformed to meet the criteria of transparency, integrity and reliability. The Police Commission must also be reformed, so that it reflects and assures a police force which is professional and fair towards good and upright members of PDRM.
PDRM belongs to the citizens of Malaysia. PDRM is an institution which is vital. It is vital not only for securing public order and safety, but also for the pursuit of justice, protection of our democracy and assuring the human rights of everyone. Following the news lately makes us thirst for a police force which demonstrates professionalism, integrity, freedom from interference, and lack of bias. We will support all efforts, regardless of who initiates or promotes them – including the IGP – to ensure that good principles and values are established, because this is in the best interest of our nation.

Press Statement from BERSIH 2.0 (26 March 2021): EC Betrays Peoples’ Mandate

 

The Coalition for Clean and Fair Elections (BERSIH 2.0) strongly condemns the Election Commission's (EC) decision to postpone the implementation of Undi18 to September 2022. EC Chairperson Datuk Abdul Ghani Salleh should immediately resign to make way for a successor who has the integrity and competence to implement the lowering of voting age to 18 (UNDI18) and Automatic Voter Registration (AVR) by July 2021 as planned.

 

The EC’s decision is a robbery of the rights of about four million Malaysians aged 18-20 to shape the direction of the country at the polls, when the next federal, state or by-election is called. Riding on the COVID-19 pandemic is absurd because it has nothing to do with the implementation of Undi18 as the necessary information already exist in the database of the National Registration Department (JPN).

 

Abdul Ghani Sallah’s lame excuse on Covid-19 is a blatant lie to confuse the public by mixing UNDI18 and AVR. There is no technicality whatsoever involved in registering voters aged 18-21. It could have been implemented in 2019 after the Constitutional Amendment was gazetted. UNDI18 was delayed only because PAS had demanded for UNDI18 and AVR to be commenced concurrently.

 

Up until November 3, 2020, eight months after the commencement of the first Movement Control Order (MCO), de facto Law Minister Dato’ Takiyuddin Hassan in his parliamentary reply to Lim Lip Eng MP of Kepong still promised that with the works carried out by a joint EC-JPN taskforce, AVR was expected to be implemented latest by July 2021, within the EC’s initial estimated timeline, ie 18-24 months from 25 July 2019, when the Constitutional Amendment was passed by the Senate.

 

The EC must answer to all Malaysians what have changed between November 3, 2020 and yesterday and whether the EC-JPN taskforce and its contractors have encountered unexpected failures in their works. The EC needs to be upfront and transparent, or it will be considered as a yes-man to the ruling party, whose senior leaders have expressed reluctance to see Undi18 being implemented.

 

Malaysians, especially the young voters, are very disappointed with the EC's decision to postpone the implementation of Undi18. BERSIH 2.0 and other civil society organisations will not hesitate to take bolder action if the EC does not speed up the implementation of Undi18 which has been delayed for almost three years.

 

BERSIH 2.0 also demands that the Prime Minister Muhyiddin Yassin immediately allow Parliament to convene that Elections (Registration of Electors) Regulations and other relevant legislations may be updated to enable implementation of UNDI18 and AVR. Muhyiddin Yassin and the EC chairman must bear the sole responsibility for any delay in the implementation of Undi18.

Laksanakan UNDI18 Segera, Pengerusi SPR Perlu Letak Jawatan

 

Gabungan Pilihan Raya Bersih dan Adil (BERSIH 2.0) mengalu-alukan kenyataan daripada Menteri di Jabatan Perdana Menteri, Datuk Seri Takiyuddin Hassan bahawa kerajaan akan melaksanakan UNDI18 dalam tempoh terdekat. Ini menunjukkan tekanan demi tekanan daripada rakyat yang menuntut hak mereka telah berjaya.

 

Namun, Datuk Seri Takiyuddin Hassan perlu memberikan satu tarikh yang jelas untuk pelaksanaan Undi18 dengan segera agar rakyat dapat menilai dan memantau pengurusan pengendalian pelaksanaan UNDI18 ini. Kenyataan bahawa ia akan dilaksanakan "dalam tempoh terdekat" boleh terbuka kepada interpretasi dan amat tidak menyakinkan semua pihak.

 

Kerajaan dan SPR juga perlu memberikan penjelasan mengapa hanya sebulan lepas mereka menyatakan UNDI18 tidak dapat dilaksanakan, namun melalui kenyataan Takiyuddin hari ini ianya boleh pula dilaksanakan dalam tempoh terdekat. Adakah sebelum ini kerajaan sengaja ingin melambatkan pelaksanaan UNDI18 dan menghalang hak anak muda berumur 18 tahun untuk turun mengundi? Adakah Pengerusi SPR juga mengikut arahan kabinet untuk melengahkan pelaksanaan UNDI18? Ini menimbulkan persoalan penting samada SPR masih sebuah badan yang bebas daripada kerajaan.

 

BERSIH 2.0 juga menggesa supaya kerajaan dan SPR untuk melaksanakan AVR seperti yang dijanjikan pada pertengahan tahun ini oleh SPR dibawah pimpinan Datuk Azhar Azizan Harun. SPR telah diberikan masa yang mencukupi untuk melaksanakan AVR dan ia tidak patut ditangguhkan lagi tanpa sebab-sebab yang jelas dan munasabah.

 

BERSIH 2.0 berpandangan bahawa Pengerusi SPR Datuk Abdul Ghani Salleh tidak kompeten dan layak untuk memikul tanggungjawab yang besar bagi melaksanakan AVR dan UNDI18. Dalih beliau sebelum ini yang mengatakan bahawa UNDI18 hanya boleh dilaksanakan pada September tahun hadapan menunjukkan beliau tidak mampu mengemudi institusi yang penting ini. BERSIH 2.0 menggesa agar beliau berundur secara terhormat sekarang sebelum reputasi buruk beliau membawa kejatuhan SPR sekali lagi.
